TERMS AND CONDITIONS

Workaway is a platform and service to connect world travellers and locals (“Workawayers”) with families and (“Hosts”) around the world to enable cultural exchange, learning possibilities, skills and information exchange and to help out in countries across the world (collectively, the “Services”).

The Services are accessible at https://www.workaway.info (“Site”).

By using the Site or Services, you agree to comply with these Terms and Conditions and to be legally bound by both them and by our Data Protection policy (collectively referred to as “Terms”), whether or not you become Host or Workawayer. Any use of the Site is governed by the Terms.

The site enables Hosts and Workawayers (“Members”) to connect. You agree that Workaway is not a party to any agreements entered into between Hosts and Workawayers nor is Workaway a travel agency, an organised exchange program, an agent or an insurer. Workaway does not monitor the Hosts or and Workawayers and disclaims all liability in this regard.

Eligibility

Workaway aims at connecting adults over 18 years old. Any use of the Site by anyone under 18 is expressly prohibited. By using the Site or Services you expressly warrant that you are an adult over 18 years old.

No Warranty

Workaway does not warranty any Listing (as defined below in Article 3) or quality of accommodation. You understand that the pictures and text on the Site are for information only and are the responsibility of Hosts and Workawayers.

You acknowledge that in case you would seek any legal remedy for actions or omissions of Workawayers or Hosts, or any third parties, you will not claim any liability against Workaway.

How Workaway Works

Hosts can register with Workaway for free to create a listing which describes the type of cultural exchange and help needed (a “Listing).

When a Host is registered, Workawayers are able to contact the Host through the Site.

Although Listings can be viewed without registering, Hosts and Workawayers must create an account to be able to contact each other.

A nominal fee is charged to Workawayers to register for one year enabling them to:

- Create a profile, upload photos and information, read feedback, leave feedback.

- Contact Hosts.

- Be contacted by Hosts.

- Contact other Workawayers.

- Contact Workawayers regarding feedback.

- Access to 24/7 human help-desk support, (including active advice on writing a profile, relevant advice and problem solving).

- Access to an emergency 24/7 support button prioritising support.

- A personal reference letter provided by our support team ( after 2 successful exchanges have taken place and feedback has been left).

- Enter our monthly photograph competition.

- Verify their identity using a Facebook plugin.

Workaway 24/7 human help-desk support and the emergency 24/7support button do not constitute a guarantee that your problem will be solved but only a commitment from Workaway to try to provide you with helpful information.

As stated above, Workaway is not a party to any agreement between Hosts and Workawayers, nor is Workaway a travel agency, organised exchange program, an agent or an insurer.

Host Registration and Obligations

When registering as a Host, you agree and confirm that:

- You are responsible for your own account security and you will not share your account details with any other person.

- You will submit your real name, address and contact details.

- All other information you provide will be accurate and true.

- You either own the accommodation you are offering through Workaway, or have suitable permissions in place to allow Workawayers to stay with you.

- If you require more than volunteer help and cultural exchange then you will supplement financially to at least meet the minimum wage of the country you are in.

- Any Workawayer you accept will genuinely benefit from the cultural exchange.

As a Registered Host, you acknowledge that:

You are using Workaway entirely at your own risk and Workaway expressly exclude all liability for any loss or damage you, your family, your reputation, your business or your property may suffer as a result of using Workaway.

Workaway provides a way for Workawayers to verify their identity however you as a Host are responsible for ensuring that any person you accept is who they say they are.

You are solely responsible for complying with the relevant rules and laws in your jurisdiction especially concerning tax, insurance, visas and other relevant requirements in line with local labour laws.

Workaway reserves the right to remove and terminate any account without warning.

You will keep your Listing up to date, and if no longer valid or required, promptly update it or remove it from the Site.

If you have what is deemed a low reply rate, we reserve the right to pause or close your account.

Workaway lists various opportunities, including but not limited to working holidays to house sitting. Please note that Workawayers should NOT be asked to help with heavy or dangerous machinery such as chainsaws, bladed power tools, machines or vehicles such as excavators, Bobcats or forklifts. These tasks are considered suitable only for professionals who have the correct training, legal qualifications and licenses, insurance, safety precautions and equipment, risk assessment, and supervision. Any Host found asking for this type of help from Workawayers will have their Listing suspended until the situation is clarified.

Workawayers are not permitted to work with hazardous materials such as Asbestos etc. Workaway reserves the right to remove Listings until the Host can provide proof that the hazardous material has been removed by a licensed professional.

As part of your Listing, you are required to upload a photo of your location or accommodation. When doing so:

You grant us a non-exclusive, transferable, sub-licensable, royalty free, worldwide licence to use that photo on your Listing and elsewhere on or in connection with Workaway.
You warrant that it is your own photo and our use of the photo will not infringe the rights of any other person. You acknowledge that photos may be suspended or removed with no warning.

As stated above, you acknowledge that Workaway is not set up to provide or replace local employment opportunities. It is your responsibility to define and comply with this. Workaway will remove or edit your Listing if we believe (in our sole discretion) that it infringes or violates another person’s rights or any laws in any country.

You acknowledge that Workaway reserves the right to notify relevant persons if your account has been suspended or removed.

Workawayer Registration and Obligations

When registering as a Workawayer, you agree and confirm that:

- You are responsible for your own account security; and you will not share your login account details with any other person.

- You are over 18 years old.

- You will submit your legal name and use your real name, address and contact details.

- You will upload a profile photo that shows your face, and maintain at least one for the duration of your subscription.

- All information you provide will be accurate and true.


You acknowledge that:

You will not be able to contact Hosts until you have paid the applicable fee. Payment may be made by Paypal, credit card or by gift code;

Workaway is a platform and service for contact. Your suitability will depend on the profile you write. We are not an agency and we do not guarantee that you will find a suitable Host; though we are available to help and provide advice.

Though we actively encourage it we cannot guarantee that any Host you contact after registering will respond to your query or be available at any particular time or on any specific dates.

Once registered, Hosts will also be able to view your profile and to contact you if interested.

We provide a way for members to verify their identity but we do not personally visit all Hosts.

You are fully responsible for investigating whether your chosen Host and the accommodation and opportunities they are offering are suitable for you and your needs;

You are using Workaway entirely at your own risk and we expressly exclude all liability for any loss or damage you, your family, your reputation, your business or your property may suffer as a result of using Workaway.

You are solely responsible for complying with the relevant rules, laws and entry requirements in your home or visiting jurisdiction especially concerning applicable visas or work permissions.

Workaway reserves the right to remove and terminate any account without warning.

You must be tolerant to ways of living and be sympathetic with any rules set by the Host.

You acknowledge that Workaway reserves the right to notify relevant persons if your account has been suspended or removed.

Hosts and Workawayer Conduct

By using the Site and Service you agree that you are solely responsible for compliance with any law, rule or regulation, that may apply to your relationship with any Host, Workawayer or any third party. You acknowledge that you will not:

Violate these Terms, any law, rule or regulation, or any order of a court.

Use the Site or Service for illegal purposes, especially to breach or violate Workaway Data Protection policy or Terms.

Use the Site or Service for commercial purposes or other purposes that would violate the Terms or any law.

Imply in any way any partnership between Workaway and you or any endorsement or affiliation with Workaway.

Harm in any way Workaway’s reputation, brand or image, including through unauthorised use of the Site or Services, infringement of Workaway’s intellectual property rights, passing off, registration and/or use of Workaway domain names, trademarks or logos or any other identifier that would create confusion with Workaway or imply a connection with Workaway.

Harass any Host or Workawayer or collect or store any personal data about them other than for purposes of the Service or engage in any abusive behavior.

Offer a Workawayer to stay in any accommodation without any permission or authorisation or submit any Listing with false or misleading information.

Register for more than one Workawayer or Host account or register for a Workaway Account on behalf of an individual other than yourself, or falsify or misrepresent yourself.

Recruit or solicit any Host or Workawayer to join third-party services or websites that are competitive to Workaway, without Workaway's prior written approval.

Use the site to promote a business or service, or to conduct surveys.

Damage the Site or Services, including, through the use of viruses, Trojan horses, forged routing or electronic mail address information or similar methods or technology.

Collect or retrieve data from our Site to compile, directly or indirectly, a collection, database, directory.

Use any software or devices to access in any way any authorized web pages on the Site or attempt to harm, decipher, decompile any of the software used to provide the Site or Services.

Damage the Site or Services, including, through the use of viruses, Trojan horses, forged routing or electronic mail address information or similar methods or technology.

Send messages interpreted as spam to other Members. This includes very short messages, identical or very similar messages, or very long messages. Doing so will result in restrictions being applied to your account and the disabling of Site features or messenger services at Workaway’s sole discretion.

Send messages or post content that is likely to cause offence, or post unpermitted content. Workaway reserves the right to interpret what is permitted or unpermitted content.

Encourage, promote or assist any third party in doing any of the foregoing.

Workaway reserves the right, without prior notice and at any time, (i) to remove or disable access to the Site or Services at its sole discretion, in case of violation of the Terms; (ii) to investigate and prosecute any violation of the Terms; and (iii) to disclose any of your information if required to do so by law.

Misconduct

If you feel someone is violating the Terms and acting inappropriately, you should immediately report such person to the appropriate authorities and then to Workaway.

If an account has been removed, suspended or terminated, it is not possible to set up a second account. Members with multiple accounts will have their accounts close and/or applications to join the site rejected.

Safety

You acknowledge that you have read and understood our Site safety guidelines and that Workaway is not, in any way, responsible for guaranteeing the safety of any Hosts, Workawayers or any person associated with either of them.

Workaway reserves the right to require a mandatory ID/ Passport identity check on your account, involving a request for verified identity documents. Workaway reserves the right to suspend any account suspected or confirmed to have provided inaccurate data

If and as permitted by applicable law, Workaway may, but has no obligation to ask you to provide identification or other information and undertake checks designed to help verify your identity or background

Workaway does not warrant that verification, identity or background checks conducted on Members will identify past misconduct or prevent future misconduct. Any references to a Member being "verified" (or similar language) indicate only that the Member has completed a relevant verification or identification process and nothing else. The disclaimers in these Terms apply to the maximum extent permitted by law. If you have statutory rights or warranties we cannot disclaim, the duration of any such statutorily required rights or warranties, will be limited to the maximum extent permitted by law.

Gift Codes

You may purchase a subscription to Workaway as a gift code to give to another person.

When purchasing a gift code, you must provide the name of the recipient.

Gift codes are non-transferable and may only be used by the recipient whose name should be provided at the time of purchase.

Once payment is received, the gift code will be emailed to your chosen recipient, who may use it when registering as a Workawayer.

Privacy

By using the site and services you agree that Workaway's Data Protection policy governs Workaway's collection and use of your personal data and information.

The Data Protection Police may be updated by Workaway from time to time.

Miscellaneous

You agree to indemnify Workaway against any claims, actions, proceedings, losses, damages, expenses and costs (including without limitation court costs and legal fees) arising out of or in connection with your use of Workaway.

Workaway may contain links or references to third party websites. Any such links are provided for your convenience only. We have no control over third party websites and accept no legal responsibility for any content, material or information contained in them. The display of any link or reference to any third party website does not mean that we endorse that website, product or service.

Services are fully delivered at the point of fee payment. Workaway strives to provide access to a variable list of hosts. However we cannot guarantee or refund under any circumstances once fee payment has been collected

Workaway may retract or change their services at any time without notice or refund.

You acknowledge that Workaway is a service to enable contact and does not act as an agent or is party to any exchange you organise.

We may modify the Terms from time to time. You agree to be bound by any changes made by us. It is your responsibility to check the Terms from time to time to verify such changes.
